When you visit this website or choose to access or use any of the tools or resources on this website you agree to such use being bound by these terms and conditions. If you do not agree with these terms, then you should not use or rely on any of the tools or resources of this website.

Continued use of the website or any of the tools and resources accessed via this website is acknowledging you accept the terms that are in place at the time of use and any decision not to keep up to date with amendments or changes by you will not provide provision for liability to be transferred to Money Managed Smarter or any of its employees, representatives or any third party accessed through connecting from the Money Managed Smarter website.

We will not provide separate notice of changes or highlight / identify a specific change however we will always have appearing at the top of the Terms and Conditions the most recent date that applies. Please check this date and if you have not checked the Terms and Conditions since the shown date please familiarize yourself with the current Terms and Conditions that apply.
2 Terminology:
The following provides meaning to various terms and words used within these Terms and Conditions
“Tools” or “Resources” refer to any online calculators, articles, budget planners or other information provided or accessible through this website
“Member” means a registered member of the website;
“Services” means those services offered through the website;
“Money Managed Smarter” means the Money Managed Smarter personal budgeting planner also known as the Moneytrainer system;
“We”, “Us” and “Our” refers to Money Managed Smarter, its employees, contractors and licensees;
“You” or “Your” refers to you;

3 No Warranty or Liability:
3.1 Everything accessible through use of this website including but not limited solely to the tools, resources, services or products is provided by us to you or members of the website with the intention to assist you or its members in becoming better informed and building a greater awareness of their personal finances in order that they can engage in well thought out financial habits or behavior.
Your use of tools, resources, services or products available or obtained from this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.
3.2 We do not (and will not) provide to you or its members investment advice. It is important for you to be aware we DO NOT replace advice that you may need to seek (at your own cost) from independent 3rd parties such as (but not limited to) accountants, lawyers, brokers and financial planners.
3.3 We takes all reasonable attempts to ensure that information on this website is reliable and accurate at the time of publishing have been taken. Should we be advised of inaccurate content by a suitably qualified professional we shall immediately remove or correct such content.

Due to the inability for us to ensure that all detail entered into our online calculators and tools are accurate and correct at the time of entry you acknowledge that this is done entirely at your risk. The results displayed are indicative only and should not be relied on without seeking further advice from either Money Managed Smarter or other professional advisers.
3.6 In situations where you seek further advice from us all reasonable endeavours will be made by us to assist you to become better informed in order that you can seek further professional or independent advice where it may be required however due to the vast variations in personal finances you also acknowledge that should further advice be undertaken from us that you indemnify us from any loss whether financial or other and that no liability or compensation shall be forthcoming or attributed to us.

B. Donations, Payments and Refunds Policy:
(1) Should you choose to make any form of payment or donation through this website for its services refunds to do not apply.
(2) All payments received are accepted as donations and as such a donations receipt will be provided with every payment received.
(3) If you do not receive a receipt or require one at any time please message us via the contact form on our website.
C. Login Information: You are solely responsible for keeping your login information, including your password, secret and secure.
D. Banking Information: No bank account or credit card information is stored on our system. All payment transactions are performed through the “STRIPE” secured site and not through the Money Managed Smarter website.
E. Response time: We endeavour to respond as soon as possible however like every business from time to time we may be delayed in responding. If you have not received a response within our reply time (two working days) then please email us at [email protected]
4 General Provisions
4.1 Calculators and guides:
They are designed to represent a general picture and indication of a user’s financial situation/options based on the information entered. If you disagree your comments help us to research and adjust these if necessary. Relying on these results without obtaining further qualified advice from a suitable professional you do so at your own risk.
4.2 System Integrity:
We will use its reasonable endeavours to ensure the availability of the web site and services, subject to any downtime required for maintenance. However, we do not take any responsibility for any system unavailability, or for any loss that is incurred by you as a result of web site or services being unavailable. We also accept no liability for any corruption of any data that you may have provided to us.
4.3 Force Majeure:
There is no liability on the part of us for any lack of performance, failure or availability of the services or the web site, where the same arises from any cause that can reasonably be seen to be beyond our control.
4.4 No Waiver:
If we do not enforce a right then this non-enforcement of such right does not constitute a waiver of any such right

In the event that these terms and conditions or any part of these terms and conditions is or are held to be illegal, unenforceable or invalid for any reason whatsoever then such part of the terms and conditions shall be deemed to be severed from the remaining terms and conditions and the remaining terms and conditions shall continue in full force and effect.

These terms and conditions are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the Courts of New Zealand.
4.7 Copyright and License to use:
The material on this website is protected by copyright. Copyright in all the information, products and services are held by Money Managed Smarter. Permission is granted to you under a limited personal use license to access, display, download, format and print portions of this site content solely for your own personal non-commercial use, provided that the content is not modified and all proprietary notices are kept intact. You may not reproduce, publish, translate, merge, sell, rent, distribute the content, or create a derivative work of the content on any other website or as part of any educational, training or reference materials.
4.8 With regard to clause 4.7 you are permitted to distribute information via the use of links to social media or third party use however only when done without modification and the original source identified in the distribution. In addition permission is only granted where distribution or reference is done in a manner that endorses the information and views being distributed.
4.9 With regard to 4.7 the online budget planner is protected by copyright and owned by Anthony Hailwood (trading as Moneytrainer) and Money Managed Smarter holds an indefinite license to use this system under its own brand.

5.1 We may modify or amend this policy at any time and for any reason.
By using this site you consent to our handling of your personal information in accordance with this policy (as amended from time to time).

B. Through your use of this site and the services and functionality offered through it.
6 Use: We will only use personal information about you for the following reasons:
6.1 To improve the products and services we offer through this site.

6.3 To add to our Moneytrainer/Money Managed Smarter database so we may inform you of specials, promotions, offers and events via email or post.

This website uses Mouseflow, a website analytics tool that helps us better understand how visitors navigate around our website. This allows us to make continual improvements for user experience and easier navigation of content.

11. Competitions, prize draws and giveaways
From time to time we may offer prizes or giveaways and other promotions or competitions. By entering such events you acknowledge and accept the following.
11.1 In the event you are a winner you give permission for your name to be used for the purposes of notifying other participants of the winner. Such notification may be shared publicly on our website or in such other communication Money Managed Smarter uses for the purposes of keeping subscribers and members informed.
11.2 Your details will appear in the following format and no other details shall be shared without your express permission.

11.3 Winners will be notified within 3 days of the close date and Money Managed Smarter reserves the sole right to draw a new winner in the event the actual winner advises they do not want their name published. In such instances where Money Managed Smarter exercises this right the actual winner agrees to forfeit the prize won.
